Scope:
These General Terms and Conditions (GTC) apply to all business relationships between Coolsulting e.U. and its customers. They form the basis for all offers and services provided by Coolsulting e.U. Conditions of the customer that differ from these GTC will only be recognized if expressly agreed to in writing by Coolsulting e.U.
Contract Conclusion and Offers:
Offers made by Coolsulting e.U. are subject to change and non-binding. The decisive factor is the written order confirmation from Coolsulting e.U. for accepting the offer. By ordering goods or services, the customer declares their intention to place the order bindingly. Regarding additional product options and add-ons, only those explicitly listed in the offer will be supplie.
Prices and Payment Terms:
Prices are quoted in Euros and exclusive of VAT. Invoices are payable within 30 days without any deductions. In case of late payment, interest on arrears will be charged at the statutory rate. Coolsulting e.U. reserves the right to demand advance payments or security deposits if the customer's creditworthiness is in question.
Delivery and Shipping:
Delivery is made at the risk and on the account of the customer. Delivery periods are non-binding unless expressly agreed otherwise. No liability can be assumed for delivery delays due to force majeure or similar circumstances.
Retention of Title:
The goods remain the property of Coolsulting e.U. until full payment is received. The customer is not permitted to pledge or transfer ownership of the unpaid goods as security.
Defects and Warranty:
Complaints about defects must be made in writing immediately upon receipt of the goods. In the case of justified complaints, Coolsulting e.U. will either replace the goods or rectify the defects, at its discretion. Further claims by the customer, especially for damages, are excluded.
Limitation of Liability:
Coolsulting e.U. is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law.
Data Protection:
Customer information is treated in accordance with data protection regulations. The customer expressly agrees to the collection, processing, and use of their personal data.
Final Provisions:
Austrian law applies. The place of jurisdiction and fulfillment is the registered office of Coolsulting e.U. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
